Terms and Conditions
An vigè depi October 21, 2026
These Terms and Conditions (“Terms”) govern your use of the ServeMart marketplace, operated by ServeMart (“ServeMart”, “we”, “us”). They apply to everyone who browses, buys, or sells on ServeMart. By creating an account or placing or accepting an order, you agree to these Terms, our Terms of Use, and our Privacy Policy.
1. What ServeMart is
ServeMart is an online marketplace that connects independent merchants (“Sellers”) with customers (“Buyers”) in Haiti and the United States. Sellers list and sell their own goods and services. ServeMart is not the seller of items listed by Sellers, does not take ownership of them, and is not a party to the sale contract between a Buyer and a Seller, except as described in Section 6 (Payments and buyer protection).
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must give accurate information and keep it up to date. One person or business may hold one Seller account unless we agree otherwise.
- You are responsible for everything done through your account. Keep your password private and tell us immediately at support@servemart.app if you think your account was accessed without permission.
3. Buying
- Prices are set by Sellers in Haitian gourdes (HTG) or US dollars (USD). Converted amounts shown in another currency are estimates. Card payments are charged in USD and MonCash payments in HTG at the exchange rate shown at checkout.
- Delivery fees, delivery areas, pickup options and delivery times are set by each Seller and shown before you pay.
- When you place an order you make an offer to buy from the Seller. The contract is formed when the Seller accepts the order.
- An order that is not paid within the time shown at checkout is cancelled automatically and the items are released.
4. Selling
If you sell on ServeMart, you agree to:
- List only items you have the right to sell, describe them accurately with honest photos, and keep prices and stock up to date;
- Comply with all laws that apply to you and your products, including licensing, product safety, food handling, labeling, import/export, customs and tax rules in Haiti, the United States and any destination country;
- Accept or decline paid orders promptly; before shipping, upload photos of the actual items; provide proof of shipment (a tracking number and/or a photo of the shipping receipt or label); and deliver within the time you advertise;
- Not list prohibited items (Section 8) and not ask Buyers to pay outside ServeMart for an order placed on ServeMart;
- Provide accurate payout details (a US bank account through Stripe, or a MonCash number) and any identity information our payment providers require.
You are solely responsible for your listings, your goods and your fulfillment, and for collecting and paying any taxes on your sales unless the law requires ServeMart to collect them.
5. Fees
Opening a store is free. ServeMart may deduct a commission from each Seller payout; the current rate is shown in the Seller studio before you sell and may change with at least 30 days’ notice. Payment-processing costs are covered by ServeMart unless we tell you otherwise in advance.
6. Payments and buyer protection
- Collection. Buyers pay ServeMart through our payment providers — Stripe for cards and MonCashConnect for MonCash. Sellers appoint ServeMart as their limited agent to accept payment on their behalf; a Buyer’s payment to ServeMart satisfies the Buyer’s obligation to pay the Seller.
- Holding period. We hold the payment until the Buyer confirms receipt in ServeMart. If the Buyer neither confirms nor reports a problem, the order completes automatically after the period shown on the order (currently a set number of days after the Seller marks it delivered, or twice that after it ships).
- Payout. When an order completes, we pay the Seller the order total minus any refunds and our commission, to the Seller’s chosen payout method. Payouts may be delayed while a payment provider, verification, or funding is pending, or while a dispute is open.
- Cancellation before acceptance. A Buyer may cancel a paid order for a full refund until the Seller accepts it. A Seller who cannot fulfil an order must decline it, which refunds the Buyer in full.
- Problems. After acceptance and before completion, a Buyer may report a problem (for example: not received, damaged, not as described) with photos. Funds stay on hold while we review the evidence from both sides, including the Seller’s pre-shipment photos and proof of shipment. We may release the payment to the Seller, refund the Buyer in full, or issue a partial refund and release the rest. Our decision on the held funds is final as between you and ServeMart, but it does not stop either of you from pursuing other remedies against each other.
- Refunds go back to the original payment method. MonCash refunds are sent to the MonCash number provided at checkout. Refund timing depends on the payment provider.
- We never see or store full card numbers; card data is handled by Stripe.
7. Reviews, messages and content
Reviews must reflect a genuine experience. Messages between Buyers and Sellers are for questions about products and orders. You keep ownership of content you upload (photos, descriptions, reviews), and you grant ServeMart a worldwide, non-exclusive, royalty-free licence to host, display, adapt (for example, resize) and use it to operate and promote the marketplace. You confirm you have the rights to everything you upload.
8. Prohibited items
You may not list or sell: weapons, ammunition or explosives; illegal or controlled drugs and drug paraphernalia; prescription medicines; stolen, counterfeit or infringing goods; hazardous materials; live animals; human remains or body parts; adult sexual content; tobacco, vaping or alcohol products where not permitted by law or without required licences; financial products, currency or gift cards for resale; anything whose sale is illegal in the Seller’s or Buyer’s country. We may remove any listing at our discretion.
9. Suspension and termination
We may suspend or close accounts, hide stores, remove listings, or withhold payouts related to an investigation if we reasonably believe someone has broken these Terms or the law, created risk for other users, or engaged in fraud. Where we can, we will tell you why. You may close your account at any time (see the Data Deletion Policy); open orders and payouts must be settled first.
10. Disclaimers
The marketplace is provided “as is” and “as available”. Sellers, not ServeMart, are responsible for the quality, safety, legality and description of their items. To the fullest extent the law allows, ServeMart disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted service, delivery times, or the accuracy of exchange-rate estimates.
11. Limitation of liability
To the fullest extent the law allows, ServeMart will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the marketplace is limited to the greater of (a) the amount of fees ServeMart earned from the transaction giving rise to the claim, or (b) USD 100. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
You agree to indemnify and hold ServeMart harmless from claims, losses and costs (including reasonable legal fees) arising from your listings, goods, content, breach of these Terms, or violation of law or third-party rights.
13. Disputes with ServeMart and governing law
Please contact us first at support@servemart.app — most issues are resolved quickly. These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any claim against ServeMart must be brought in the state or federal courts located in Lee County, Florida, and you consent to their jurisdiction, except that either party may bring an individual claim in small-claims court where eligible. If you live in a country whose consumer-protection laws give you rights that cannot be waived, those rights still apply.
14. Changes
We may update these Terms. If a change is material, we will tell you by email or in the app at least 14 days before it takes effect. Continuing to use ServeMart after the effective date means you accept the updated Terms.
